The agreement between you and Garnish when you use the Service.

1. Acceptance of terms

These Terms of Service (the "Terms") form a binding agreement between you and Garnish ("Garnish," "we," "us," or "our") and govern your access to and use of the Garnish website at cookgarnish.com, our mobile and web applications, and any related services (collectively, the "Service").

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you don't agree, please don't use the Service.

2. Eligibility

You must be at least 13 years old (or 16 in the EU/UK) to use the Service. If you are under 18, you must have permission from a parent or legal guardian. By using the Service, you represent that you meet these requirements and that you have the legal capacity to enter into these Terms.

"User Content" means anything you submit, upload, or share through the Service — including photos, ratings, comments, notes, recipe modifications, and shopping lists.

You retain ownership of your User Content. By submitting it, you grant Garnish a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify (e.g., resize images), publicly display, and use your User Content solely to operate, provide, improve, and promote the Service.

You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate these Terms or any third-party rights. We may, but are not obligated to, review, remove, or refuse to display User Content that we believe violates these Terms.

You may delete your User Content at any time. We may retain backup copies for a reasonable period as described in our Privacy Policy.

6. Intellectual property

The Service — including all software, designs, text, graphics, logos, icons, and the curated recipe database — is the property of Garnish or our licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.

"Garnish" and the Garnish logo are trademarks of Garnish. You may not use them without our prior written permission. All rights not expressly granted are reserved.

7. Recipes, nutrition & dietary disclaimer

Important: Recipes, ingredient lists, nutrition facts, and dietary classifications on Garnish are provided for informational purposes only. They are not medical, nutritional, or dietary advice. Always consult a qualified professional for guidance specific to your health, allergies, or dietary needs.

You are solely responsible for:

Nutrition information is estimated and may vary based on specific ingredients, brands, portion sizes, and preparation methods. Garnish is not liable for any adverse reaction, illness, or injury arising from your reliance on recipe or nutrition information provided through the Service.

8. Third-party services & Amazon Fresh

The Service integrates with third-party services, including Amazon Fresh for grocery delivery. When you use these features, the third party's terms and privacy policies apply to their services, and you transact directly with them. Garnish is not a party to those transactions and is not responsible for:

Some features of the Service may require a paid subscription ("Premium"). If you purchase Premium:

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Garnish disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

Garnish does not warrant that the Service will be uninterrupted, secure, error-free, or that defects will be corrected; nor that any content (including recipes and nutrition information) is accurate, complete, or current. Any reliance on the Service is at your own risk.

11. Limitation of liability

To the fullest extent permitted by law, in no event will Garnish, its affiliates, officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or relating to your use of, or inability to use, the Service, even if Garnish has been advised of the possibility of such damages.

In no event will Garnish's total aggregate liability arising out of or relating to these Terms or the Service exceed the greater of (a) the amount you paid Garnish in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred US dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Garnish and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

You may stop using the Service at any time and delete your account through account settings or by emailing support@cookgarnish.com.

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including 5, 6, 10, 11, 12, and 14) will survive.

14. Governing law & dispute resolution

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws principles.

Informal resolution

Before filing a claim, you agree to try to resolve the dispute informally by emailing us at legal@cookgarnish.com. We will try to resolve the dispute within 60 days.

Binding arbitration

If we can't resolve the dispute informally, you and Garnish agree to resolve any claim arising out of or relating to these Terms or the Service through final and binding individual arbitration administered by a recognized arbitration provider, conducted under their then-current rules. The arbitration will be held in Ventura County, California or another mutually agreed location, or by video conference.

Class action waiver

You and Garnish each waive the right to bring or participate in any class, collective, or representative action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

Exceptions

Either party may bring an individual action in small-claims court, or seek injunctive relief in court for infringement or misuse of intellectual property rights.

Opt-out

You may opt out of the arbitration agreement and class-action waiver by emailing legal@cookgarnish.com within 30 days of first accepting these Terms with the subject "Arbitration Opt-Out" and including your name and email address.

15. Changes to these terms

We may modify these Terms from time to time. If we make material changes, we will notify you by email or through the Service and update the "Last updated" date. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you don't agree to the changes, please stop using the Service.
